By accessing or using the Elevate Golf app and associated services (“Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you may not use the Platform. These Terms apply to all users, including players, coaches, and guardians where applicable.

2. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after such updates constitutes your acceptance of the revised Terms.

3. Eligibility

The Platform is intended for use by individuals of all ages, including children under 18 who wish to learn golf. However, users under the age of 16 must obtain express parental or guardian consent to create and operate an account. Parents or guardians are responsible for supervising their child’s use of the Platform and for ensuring compliance with applicable laws and these Terms.

4. Use of Personal Data and Third-Party Partners

We collect and process personal data in accordance with our Privacy Policy. Some data may be shared with trusted third-party service providers, such as payment processors, analytics providers, or content delivery networks, solely for the purpose of operating, improving, and supporting our Platform. All third parties are bound by contractual obligations to safeguard your data.

5. Account Responsibilities

Users must provide accurate, complete, and current information when creating an account. Users are responsible for maintaining the confidentiality of their login credentials and for all activities under their account.

6. Intellectual Property

All intellectual property rights in the Platform and its content are owned by or licensed to Elevate Golf. You may not copy, modify, distribute, sell, or lease any part of the Platform without written permission.

7. Marketplace and Coaching Content

The Platform facilitates interactions between players and coaches. Elevate Golf is not a party to any contract between users. Coaches are responsible for the content and quality of their interactions and services. We do not guarantee any learning outcomes.

8. Payments and Refunds

All payments are handled via third-party providers. By making a payment, you agree to the provider’s terms. Refunds, where applicable, will be governed by our internal refund policy and may be limited or denied if abuse is detected.

9. User Conduct

Users agree not to engage in any unlawful, abusive, or harmful behaviour on the Platform. This includes but is not limited to harassing others, sharing inappropriate content, or misrepresenting identity.

10. User-Generated Content

By uploading or submitting any content (text, video, comments), you grant Elevate Golf a worldwide, royalty-free, sublicensable license to use, host, reproduce, and display such content for operational and promotional purposes.

11. Children’s Privacy

We welcome young users who are learning golf. However, if you are under 16, you must have the consent of a parent or legal guardian to register and use the Platform. Parents and guardians may be required to provide consent through a verification mechanism. If we become aware that a child has registered without such consent, we will remove the account and any associated data.

12. Data Security

We take reasonable technical and organizational measures to safeguard your personal data. While we do not use traditional passwords, access to the Platform is controlled through secure email-based OTP (One-Time Password) verification. Users are responsible for maintaining the security of their email accounts to prevent unauthorized access. However, no method of transmission or storage is entirely secure, and we cannot guarantee absolute protection of your information.

13. Disclaimers

The Platform is provided “as is.” We make no guarantees about the accuracy, completeness, or usefulness of any information or services offered. Use of the Platform is at your own risk.

14. Limitation of Liability

To the extent permitted by law, Elevate Golf shall not be liable for indirect, incidental, or consequential damages resulting from your use of the Platform.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
