1. Purpose & Scope
This Acceptable Use Policy (“AUP”) sets the rules for how you may use the ElevateGolf mobile application, website and related services (the “Platform”). It applies to all users, including Players, Coaches and visitors. By using the Platform you agree to comply with this AUP, our Terms and Conditions, Privacy Policy, Refund Policy, Coach Agreement, and our Intellectual Property Infringement Policy.
2. Key Definitions
2.1 “Player” means a user who purchases a Tip from a Coach.
2.2 “Coach” means a certified instructor (golf, fitness or related disciplines) authorised to sell Tips on the Platform.
2.3 “Tip” means personalised video, audio or written advice created by a Coach for a Player.
2.4 “Content” means any text, images, videos, audio, profiles, reviews, links or other material uploaded to or transmitted via the Platform.
3. General Conduct Rules
3.1 Lawful Use. You must not use the Platform for any unlawful, deceptive or harmful activity, including fraud, money-laundering, or evasion of sanctions or export controls.
3.2 No Harassment or Hate. You must not harass, bully, threaten, incite violence or promote discrimination or hatred against individuals or groups based on protected characteristics (including race, ethnicity, religion, disability, sex, gender identity, sexual orientation, or age).
3.3 Safety & Violence. No violent, gory, or self‑harm content; do not encourage dangerous acts. Report imminent risks to local authorities.
3.4 Sexual Content & Nudity. Pornography and sexual exploitation are prohibited. Do not share sexualised content involving minors or young‑looking persons.
3.5 Minors’ Safety. Users under 13 are not permitted. Users aged 13–17 may use the Platform only with parental consent. Do not solicit or attempt to contact minors, and do not exchange personal contact details with any user.
3.6 No Off‑Platform Solicitation or Contact Sharing. You must not request or share personal contact details (e.g., phone numbers, email addresses, social handles), or solicit/arrange off‑Platform communications, payments or lessons. If a Coach asks you to move off‑Platform, please report it via the “Report a Coach” function or to support@elevategolf.com.
3.7 Spam & Manipulation. No spam, scams, phishing, review or rating manipulation, or artificial traffic. Do not create fake accounts or impersonate others.
3.8 Security & Integrity. Do not interfere with or disrupt the Platform, bypass security, reverse‑engineer, scrape, or use bots or automated tools to access or collect data without our prior written consent.
3.9 Malware & Technological Harm. Do not upload malware, spyware, or code that could impair the Platform or users’ devices.
3.10 Privacy & Personal Data. Do not collect, publish, or misuse personal data of others, and do not post content that reveals private information (e.g., doxxing).
3.11 Payments. Do not attempt to evade our payment processes or PayPal® policies, or encourage chargeback abuse.
3.12 Advertising & Promotions. Do not advertise third‑party goods or services, affiliate schemes, or sponsorships on the Platform without our prior written approval.
4. Content Standards
4.1 Ownership & Permissions. Upload only content you own or are authorised to use. Do not infringe copyright, trade marks, publicity or other rights. Do not remove watermarks or rights‑management information.
4.2 Reference/Comparison Videos. Coaches may upload reference or comparison footage only where they hold rights or a valid licence. You are solely responsible for ensuring such footage is lawful; we may remove it upon notice of infringement.
4.3 Sensitive Content. No illegal content, explicit sexual content, exploitation, or content that depicts illegal drug use or criminal activity.
4.4 Health & Safety Information. Coaching, fitness and nutrition guidance on the Platform is educational only and not medical advice. Users must exercise personal judgement and seek professional medical guidance where appropriate.
4.5 Annotations & Editing. Use of our video editor and annotation tools must not be used to mislead, defame, or suggest endorsement by third parties.
5. Coach-Specific Obligations
5.1 Professional Conduct. Maintain a courteous, professional standard in all interactions; do not harass or pressure Players.
5.2 No Off‑Platform Deals. Do not solicit or arrange lessons, communications or payments outside the Platform, and do not request contact details from Players.
5.3 Use of Player Content. Use Player videos and information only to create the purchased Tip. Do not download, screen‑grab, disclose or reuse Player Content for other purposes without explicit permission.
5.4 Brands & Endorsements. Do not promote brands, products or affiliate links without our written approval.
5.5 Clarifications. You must respond professionally to one‑time Player clarification requests through the Platform’s permitted mechanism.
6. Player-Specific Obligations
6.1 Personal Use. Tips are licensed for your personal, non‑commercial use. Do not redistribute, publish, or monetise Tips without permission.
6.2 Accuracy. Provide accurate information about your goals and any injuries or limitations; you are responsible for your own safety when applying tips.
6.3 Respectful Behaviour. Do not harass Coaches, demand off‑Platform contact, or threaten low ratings to coerce outcomes.
7. Reviews & Ratings
7.1 First‑Hand Experience. Reviews must reflect your genuine experience with the specific Tip or Coach.
7.2 No Abuse or Bias. Do not use profanity, hate speech, discriminatory language or defamatory statements, and do not coordinate review campaigns.
7.3 Our Rights. We may moderate, remove, or decline to publish reviews that violate this AUP.
8. Reporting & Escalation
8.1 In‑App Reporting. Use “Report a Coach” on a Coach profile or “Report Content” where available to flag violations.
8.2 Email. You can also email support@elevategolf.com with details (URLs or Tip IDs, screenshots, description). For intellectual‑property issues, email ip@elevategolf.com and follow our IP Infringement Reporting Process.
8.3 Emergencies. For imminent threats, contact local authorities first, then notify us.
8.4 Our Process. We review reports, may request additional information, and take appropriate action consistent with our Content Moderation SOP.
9. Enforcement & Consequences
9.1 Actions We May Take. We may remove content, issue warnings, limit functionality, impose temporary suspensions, permanently terminate accounts or device‑ban, hold or reverse payouts (per the Refund Policy and Coach Agreement), or refer matters to law enforcement.
9.2 Three‑Strike Approach. We generally apply a three‑strike policy for standard violations, but may take immediate action (including permanent termination) for severe or egregious breaches (e.g., exploitation of minors, hate speech, threats of violence, or clear IP piracy).
9.3 Transparency. Where feasible, we will notify you of the reason for enforcement and provide basic guidance on how to avoid repeat violations.
10. Repeat Infringer Policy (IP)
We may terminate accounts of users who repeatedly infringe intellectual property rights. Content may be removed upon credible notice; repeat offenders may be permanently banned.
11. Appeals
If you believe an enforcement action was in error, you may appeal within 14 days by replying to our notice or emailing support@elevategolf.com with your account email, the decision you are appealing, and any supporting information. We will review and respond in a reasonable timeframe.
12. Relationship to Other Policies
This AUP forms part of our Terms and Conditions. In case of conflict, the Terms and Conditions prevail. Additional obligations may apply to Coaches under the Coach Agreement and to all users under the Refund Policy, Privacy Policy, and IP Infringement Policy.
13. Changes to this AUP
We may update this AUP from time to time. We will post the revised date above and, where material, provide 30 days’ notice via the Platform or email. Continued use after the effective date constitutes acceptance.
